Terms of Use

1. Definitions

• Beneficiary: The person or entity to whose account funds raised in a Campaign are transferred for utilisation.
• Campaign: A fundraising campaign initiated on the Platform by a verified NGO / organisation.
• Campaigner: A verified NGO or organisation that has successfully completed our onboarding and KYC process and initiates a Campaign on the Platform.
• Donor / Funder: Any User who makes a donation to a Campaign listed on the Platform.
• Platform / Site: The web platform at www.sacchisewa.org.
• User: Any person or entity that accesses, uses, or visits the Platform / Site, avails the Services, or makes a donation towards any Campaign.

You accept these Terms by:

• Creating an account or registering on the Site
• Making a donation through the Platform or
• Using any feature or service of the Platform.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Sacchi Sewa with respect to use of the Platform.

4. Modifications

Sacchi Sewa reserves the right to modify these “Terms of Use” at any time. Changes will be posted on the Platform with an updated "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance. If changes are material, we will make reasonable efforts to notify registered users via email.

5. Account Registration

You may browse the Platform without registering. Certain features - including initiating a Campaign or accessing donation history — require registration. You agree to provide accurate, complete, and up-to-date information. You are solely responsible for all activity on your account and for maintaining the confidentiality of your login credentials.

You may deactivate your account at any time by contacting us at support@sacchisewa.org. Upon deactivation, your transactional and personal data will be retained for a period required under applicable laws pertaining to the jurisdiction of India (including tax and financial record-keeping laws), after which it will be deleted.

6. Fund Transactions and Accountability

Sacchi Sewa as a Platform:

• Is not the final recipient of funds from Donors, but a facilitator enabling receipt of funds by Campaigners.
• Holds funds in its designated bank account until disbursement conditions are met.
• Disburses funds to the Campaigner / Beneficiary subject to completion of KYC and verification requirements. Fund disbursement timelines are determined by operational requirements and regulatory compliance and are communicated to Campaigners at the time of campaign approval.
• Does not guarantee that the target fundraising amount of a Campaign will be fully raised.
• Does not offer the Platform for equity investment, loans, or profit-sharing arrangements.

7. Fees and Charges

Platform service fees, payment gateway charges, GST, and other applicable taxes are deducted from funds raised on the Campaign.

Sacchi Sewa reserves the right to revise the fee structure at any time. Fee changes will be announced, amended, or reported on the Platform. The fee applicable to a Campaign is the fee in effect at the time of each donation processed — not at the time the Campaign was approved. Campaigners are responsible for monitoring the current fee schedule before initiating or continuing a Campaign. All fees are non-refundable.

Important notice to Campaigners: You should review the current fee schedule before running or continuing a Campaign, as fees may be revised at any time.

• All Campaigns are initiated with the express consent and free will of the Campaigner / Beneficiary.
• The Platform is a technology intermediary between people seeking financial assistance and the public willing to support them.
• Sacchi Sewa reserves the right to accept or reject any Campaign in line with its verification processes and policies.
• All Campaigners represent that they are at least 18 years of age and are legally capable of entering into a binding agreement.

The Platform may contain links to third-party websites or services. Sacchi Sewa is not responsible for the content, accuracy, legality, or privacy practices of any third-party websites. Access to third-party links is at your own risk.

12. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software is the property of Sacchi Sewa or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

By submitting Campaign content (text, images, videos) to the Platform, Campaigners shall grant Sacchi Sewa a non-exclusive, royalty-free licence to use, display, and distribute such content for the purpose of operating and promoting the Platform and the Campaign. It is the sole responsibility of the Campaigner to ensure that submitted content is original and that they have legal claim and ownership of the right to use and propagate it.

13. Fraud, Misuse, and Enforcement

If Sacchi Sewa determines or reasonably suspects that a Campaigner has misused funds raised through the Platform:

• The Campaigner's account and all active Campaigns will be immediately suspended.
• The matter will be referred to appropriate law enforcement authorities and legal proceedings will be initiated against the Campaigner.
• Undisbursed funds (if any) held at the time of suspension will be handled as described in Clause 8.3.

Important for Donors: While we take misuse of funds extremely seriously and take strong legal and enforcement action, please be aware that Sacchi Sewa cannot guarantee recovery of misused funds or automatic refunds. We strongly encourage Donors to review Campaign details carefully before donating.

14. Refund Policy

Donations made on the Platform are generally non-refundable. Refunds will only be processed in the following specific circumstances:

• A payment has been identified as having been made via a stolen, cloned, or unauthorised payment instrument, and the legitimate account holder has raised a claim — subject to verification.
• A technical error has resulted in duplicate or erroneous charges — subject to verification.

All approved refunds are credited to the original payment method within 5-10 working days of approval.

Dissatisfaction with the outcome of a Campaign, change of mind, or suspicion of misuse (without confirmed evidence) do not constitute grounds for a refund. In cases of confirmed fraud by a Campaigner, please refer to Clause 13.

15. Limitation of Liability

Sacchi Sewa, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform, the Services, or any Campaign.

Our total aggregate liability to any User in connection with these Terms shall not exceed the total amount of the specific transaction that gave rise to the applicable claim.

Any grievance or complaint relating to the use of the Platform or any content thereon must be submitted to the Grievance Officer. We will acknowledge receipt of your complaint within 3 business days and endeavour to resolve it within 30 business days of receipt, in accordance with applicable law.

17. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
